Welcome to Totally Home and Totally Kids Furniture (Totally Home LLC)!

Please take a few minutes to review these Terms and Conditions. Your purchase of products from us constitutes your agreement to follow these Terms and Conditions and to be bound by them. From time to time there may be information on our website that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, and availability. Totally Home LLC reserves the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice (including after you have submitted your order).

You must be present at the time of delivery to receive and inspect your shipment. It is important to be as detailed and descriptive as possible on the delivery receipt that the delivery driver will give you before you sign for your items. A signature indicates acceptance, so if you sign without inspecting the box or its contents, then you are accepting the shipment "as is". We will not be able to file a damage claim with the shipper on your behalf unless you notate any damages at the time of delivery. If the box is compromised in any way, you must notate "box damaged, exposed product, damage to product" on the delivery receipt. If there are any damaged or missing pieces, you must note this on the delivery receipt. If the box/packaging are not available for your inspection, be certain to note that on the delivery receipt. Any damages must be reported to our customer service department within 5 days of receipt of the item. Remember that if you sign the delivery receipt without notating damages, we cannot be responsible for assisting you in the repair or replacement of the merchandise. Failure to accept delivery within 5 days of shipment availability will result in additional fees.

If we request additional information from you, such as photos, serial numbers, or repair estimates, and do not receive a response within 30 consecutive calendar days, we will consider the order accepted in its current condition and no further remedies will be available.

Totally Home LLC reserves the right to update or modify these Terms and Conditions at any time without prior notice. For this reason, we encourage you to review these Terms and Conditions whenever you purchase products from us or use our web site. Any action relating to the use of the web site or any transaction with Totally Home LLC must be brought in the state or federal courts located in Travis County, Texas. Mattresses are not returnable.

Threshold Delivery

Threshold delivery service provides delivery of your item(s) to the first dry door (building, garage, inside front /porch door). It does not include any unpack or debris removal. It includes liftgate delivery, approximately 15 minutes on-site, appointment scheduling, and requires a signature.

Curbside Delivery

Curbside delivery service provides delivery of your item(s) to the curb at the end of your driveway. This service does not include set up or assembly of items or removal of packaging materials.
  1. Your item will be shipped to a local delivery terminal.
  2. The delivery terminal will call you when your item arrives to schedule a delivery appointment.
  3. Deliveries are made typically between the hours of 8:00 AM and 5:00 PM Monday through Friday and will be scheduled as a 4-hour window. These hours may vary by carrier and location.
  4. Your item will be delivered on a lift gate truck and will be taken off the truck by the delivery driver.

All Deliveries

  1. Upon delivery please inspect your item(s). You will be required to sign a Proof of Delivery receipt. Please note any damage to the item or packaging on the delivery receipt or, if refusing delivery due to damage please note refused due to damage on this receipt.
  2. A signature is required for all deliveries; the driver is unable to complete delivery without a signed delivery receipt.
  3. Refusing delivery or failing to schedule delivery turns your order into a return and return charges will apply. This includes not answering calls or having the wrong information on your order. Please double check you have the correct contact information on your order.
Note, if you live down a road or driveway that the delivery truck cannot access without causing damage to the truck we may not be unable to complete delivery or may require additional coordination resulting in non-standard service charges.

Damages

Totally Home makes every effort to ensure your order arrives in perfect condition the first time. Although we take extensive precautions to protect your furniture and work only with trusted, vetted delivery partners, damage may occasionally occur.

In the event of damage or a defect, the customer agrees to allow Totally Home, the manufacturer, and/or our shipping agent the opportunity to resolve the issue. Any approved resolution will be provided at no cost to the customer. The customer agrees to accept the remedy selected by Totally Home, the manufacturer, or the shipping agent.

Our goal is always to make things right and ensure our customers are satisfied. However, if a customer chooses to return or cancel the order instead of allowing us to remedy the issue, the order will be treated as a cancellation and will be subject to our cancellation and return policy.

In the rare event that damage occurs, the following protocols apply:

All damage or improper assembly must be reported at the time of delivery and noted on the Bill of Lading. If damage or assembly concerns are not documented at delivery, Totally Home may not be responsible for remedy, restoration, or replacement.

If a product is found to be damaged and the damage is properly noted on the delivery receipt, Totally Home will work to correct the issue at our expense. Remedies may include, but are not limited to, service by a professional furniture repair technician, replacement parts, a combination of repair and replacement parts, or full unit replacement, all at no cost to the customer.

All shipments are insured against damage. When your order arrives, please take a few moments to confirm that the delivery paperwork is accurate and that the correct items and/or number of cartons have been delivered. Please also inspect the packaging and contents for any signs of shipping damage.

Any shipping damage must be noted on the delivery receipt at the time of delivery so an insurance claim can be filed. If only part of the order is damaged or if there is a shortage, please accept all items and clearly list any damages and/or shortages on the delivery receipt. Accepting all items facilitates a quicker replacement process.

Concealed damage must be reported to us and the shipper within 24 hours of arrival. Concealed damage is freight damage or shortage discovered only after delivery, when the packaging is opened and the goods are inspected, meaning it was not noted on the Proof of Delivery (POD). Because the consignee signs for a "clean" delivery, these claims are harder to prove and require prompt reporting.

If the order shows or develops a manufacturer defect after delivery and within the manufacturer’s warranty period, please contact Totally Home for assistance.

 
 
 
*SHIPPING PROMOTION EXCLUSION*
Due to factors that affect freight shipping requirements, orders containing only case goods such as dressers, nightstands, desks, bookcases, trundles, and storage drawers do not qualify for most free shipping promotions and may incur standard freight shipping charges. Case goods ordered along with qualifying items such as beds and bed combinations qualify for free shipping promotions.
Additional shipping charges may apply for international, Alaska, Hawaii, and U.S. Territories orders. These locations are not eligible for free shipping promotions due to carrier constraints.

Disclaimers

Dimensions displayed by Totally Home or the manufacturer are occasionally rounded to the nearest whole number. The customer accepts liability if the dimensions of the furniture received are within accepted variance rate of the manufacturer.

Finishes and colors displayed online may not accurately represent the true color or pattern of the item(s). You, the Customer accepts liability for your purchase in the event that any of the following occurs; the customer received delivery of an item(s) with a finish, color or texture that varies from what you saw on the website or any website other, at a physical furniture store or per any recommendations you may have received from a sales representative.

The customer is responsible for reviewing the order confirmation details sent to them, and notifying Totally Home within 24-hours if you did not receive the order confirmation email, and contacting us regarding any errors or inaccuracies so that order details may be revised by Totally Home to reflect the correct information.

Before ordering, measure the space you plan on placing your new furniture in to ensure fit. If purchased item(s) cannot fit into the home or room and need to be returned, the order will be subject to the return and cancellation policy.

Errors on Our Site: We try to be as accurate as possible. However, we do not warrant product descriptions or other site content are accurate, complete, reliable, current, or error-free. Prices and promotions are subject to change. In rare instances an item listed as available on our site may not be available, or an item may be mispriced, despite our best efforts. For any of these reasons, we may cancel your order, or we may contact you for instructions on the order.

Sales Tax

Your order may be subject to sales tax required to be charged based on specific state and local tax rates.

Coupon Exclusions

Coupons or promotions may not apply to all items. Lego is often excluded from coupons and promotions to meet MAP requirements.
